1. Agreement to Terms

By accessing or using the 3DWalker LLC website (“Site”), booking a service, or purchasing any property media package, you agree to these Terms of Service (“Terms”). If you do not agree, please do not use our Site or services.

“3DWalker,” “we,” “us,” and “our” refer to 3DWalker LLC.

2. Services Provided

3DWalker LLC provides real estate and property-related media services, including but not limited to:

  • HDR Photography
  • 3D Virtual Tours (Digital Twins)
  • Floor Plans
  • Drone Photography & Drone Video
  • Interior Walkthrough Video
  • Editing and delivery of media assets
  • Online file hosting (links to 3D tours, galleries, and footage)

All service details are provided on the Pricing and Services pages of our website.

3. Booking & Scheduling

3.1 Online Booking

All appointments are scheduled through our online booking system (Spiro or similar). You are responsible for providing accurate information, including:

  • Property address
  • Approximate square footage
  • Access instructions
  • Service selection and any add-ons

3.2 Arrival Window

Technicians arrive within a reasonable time window based on scheduling logistics. If delays occur (traffic, weather, prior appointment running long), we will notify you as soon as possible.

3.3 Property Access

You must ensure safe, legal access to the property at the scheduled time.
If the property is inaccessible or unsafe, the appointment may be canceled or rescheduled at our discretion, and a cancellation fee may apply (see Section 8).

4. Client Responsibilities

You agree to:

  • Ensure the property is photo-ready (clean, staged, and decluttered)
  • Secure pets, valuables, and sensitive materials
  • Notify us in advance of any restrictions (e.g., HOA rules, no-flight zones, tenant occupancy)
  • Provide accurate square footage to ensure correct pricing
  • Acquire any required permissions for filming, scanning, or drone operations

We are not responsible for delays caused by property preparation issues.

5. Drone Operations

Drone services are subject to:

  • FAA regulations (Part 107 compliance)
  • Weather conditions
  • Local restrictions (airspace, private community rules, etc.)

If weather or airspace prohibits flight, we will either:

  • Reschedule the drone portion, or
  • Issue a refund for the drone component only

Drone operations cannot occur in restricted zones or unsafe conditions.

6. Delivery Times

We aim to deliver all media within 24 hours of the shoot unless otherwise stated or if the project requires additional editing. This includes:

  • Photo galleries
  • 3D tour link
  • Floor plan files
  • Drone photos
  • Video files

Larger or commercial projects may require additional time.

7. Payment Terms

7.1 Payment Timing

Payment is due:

  • At the time of booking, or
  • Within 24–48 hours after delivery (if post-payment option is chosen)

7.2 Accepted Payments

We accept:

  • Credit cards (processed securely by third-party processors)
  • Digital payments (if enabled)
  • ACH or invoice-based payment for repeat clients (case-by-case)

3DWalker does not store or process credit card numbers directly.

8. Cancellation & Rescheduling

8.1 Free Rescheduling

You may reschedule at no cost up to 24 hours before the appointment.

8.2 Late Cancellation Fee

Cancellations within 24 hours of the appointment may incur a $75 late-cancel fee.

8.3 No-Show Fee

If our technician arrives and the property is inaccessible, a $100 no-show fee may apply.

9. Use of Media / Licensing

9.1 Ownership

All photos, videos, floor plans, and 3D tours are owned by 3DWalker LLC.

9.2 Usage License

Upon payment, you receive a non-exclusive, royalty-free license to use the media for the purpose of marketing a property or showcasing your professional work.

You may:

  • Use the media in real estate listings
  • Share on social media
  • Use in presentations or marketing materials

You may not:

  • Sell or license the media to third parties
  • Use it after the listing or contract has ended (unless you are the property owner)
  • Remove watermarks (if present)
  • Claim authorship or ownership of the media

9.3 Portfolio Use

3DWalker may use selected media for our own marketing unless you request otherwise in writing.

10. Accuracy & Limitations

10.1 Floor Plans

Floor plans are generated from 3D scans and are approximate.
They are not to be used for:

  • Architectural design
  • Construction
  • Permitting
  • Engineering approval

10.2 Measurements & Data

3D tours provide approximate measurements and spatial estimates; they are not guaranteed to be exact.

11. Liability Disclaimer

3DWalker is not liable for:

  • Lost business or revenue due to service delays
  • Inaccuracies in floor plans or measurements
  • Issues caused by property preparation
  • Technical issues with third-party hosting platforms
  • Weather-related disruptions (drone or exterior shooting)

Our maximum liability for any claim is limited to the amount paid for the service.

12. Third-Party Providers

Our Site and services may integrate with third parties, including:

  • Spiro (booking & scheduling)
  • Payment processors (Stripe, Square, etc.)
  • 3D hosting platforms (e.g., Realsee)
  • Photo/video delivery platforms (MLS-safe galleries)
  • Analytics tools (Google Analytics)

Your use of these services is subject to their respective terms.

13. Changes to These Terms

We may revise these Terms from time to time. The updated version will be posted on this page with a new “Effective Date.” Continued use of the Site or services indicates acceptance.

14. Governing Law

These Terms are governed by the laws of the State of New York, without regard to conflict-of-law principles.

Any disputes must be resolved in the state or federal courts located in Suffolk County, NY.
